These Terms and Conditions ("Agreement") set out the basis on which Damrong ("we", "us", "our") provides inheritance legal services to clients ("you", "User") in Thailand. Please read these terms carefully. By engaging our services or using this website, you confirm that you have read, understood, and agreed to this Agreement.

1. Definitions

In this Agreement, the following terms carry the meanings set out below:

  • "Agreement" means these Terms and Conditions, together with any engagement letter or service proposal we provide to you.
  • "Services" means the inheritance and estate legal services described in Section 3 below.
  • "User" / "you" / "your" means any individual or family representative who accesses this website or engages Damrong for legal assistance.
  • "We" / "us" / "our" refers to Damrong, a legal services firm registered and operating in Bangkok, Thailand.
  • "Content" means all text, documents, materials, and information published on this website.
  • "Website" means the site accessible at this domain and all associated pages.

2. Acceptance of Terms

By accessing this website or requesting our Services, you confirm that:

  • You are at least 18 years of age, or are a legal representative acting on behalf of a family or estate;
  • You have the legal capacity to enter into a binding agreement;
  • You accept these terms on your own behalf and, where applicable, on behalf of the estate or family matter you represent.

If you do not agree with any part of this Agreement, please refrain from using our website or engaging our services.

3. Service Description

Damrong provides inheritance and estate legal services to individuals and families in Thailand. Our three core service offerings are:

  • Legacy Planning Consultation — an initial consultation to understand your family's circumstances and outline options for estate arrangement.
  • Estate Document Drafting — careful preparation of wills and related legal documents in accordance with Thai law.
  • Full Inheritance Handling — comprehensive legal support covering documentation, formal proceedings, and representation throughout an inheritance matter.

Our Services are provided in Bangkok, Thailand, and are governed by Thai law. We are not able to advise on foreign jurisdictions, though we can refer you to appropriate specialists where needed.

Availability of Services is subject to practitioner capacity. We will inform you promptly if we are unable to take on a matter.

4. User Responsibilities

When engaging our Services, you agree to:

  • Provide accurate, complete, and timely information relevant to your matter;
  • Inform us promptly of any changes to circumstances that may affect your matter;
  • Respond to our communications within a reasonable time to avoid delays;
  • Use this website only for lawful purposes and in a manner that does not infringe the rights of others;
  • Refrain from submitting false, misleading, or fraudulent information.

We reserve the right to decline or withdraw from a matter if we believe inaccurate or incomplete information has been provided, or if continuation would be inconsistent with our professional obligations.

5. Intellectual Property

All content on this website — including text, design, logos, and document templates — is owned by or licensed to Damrong and is protected under applicable Thai and international intellectual property law.

We grant you a limited, non-exclusive, non-transferable licence to access and use this website for the purpose of learning about and engaging our Services. This licence does not permit you to:

  • Copy, reproduce, or distribute website content for commercial purposes;
  • Modify or create derivative works from our materials without written consent;
  • Use our name, logo, or materials in a way that implies endorsement without our agreement.

Documents we draft for your matter remain your property upon full payment of fees. Draft documents prepared prior to full engagement remain our property until a formal agreement is in place.

6. Payment Terms

Our service fees are denominated in Thai Baht (฿) and are set out in our service proposal or engagement letter. Indicative fees for each service are published on our website for general guidance.

Payment methods

We accept bank transfer and other methods as agreed at the time of engagement. Details will be provided in your engagement letter.

Invoicing and settlement

Invoices are issued upon agreement of scope and are payable within 14 days unless otherwise agreed. For multi-stage matters, staged payment schedules may be arranged.

Cancellation and refunds

Where work has not yet commenced, fees paid in advance may be refunded in full on written request. Where work is underway, a fair assessment of work completed will be made and any balance returned to you. We will handle all such requests with care and transparency.

7. Service-Specific Terms

The following additional terms apply to our legal services:

Scope and instructions

The scope of each matter will be agreed in writing before work commences. Any significant change to scope will be discussed with you and reflected in a revised proposal or supplementary instruction.

Confidentiality

We treat all information relating to your matter with strict confidentiality in accordance with our professional obligations and the Thailand Personal Data Protection Act B.E. 2562 (PDPA). Please also see our Privacy Policy.

Timelines

We provide estimated timelines in good faith. Some matters involve third-party processes — such as court or government office procedures — over which we have no direct control. We will keep you informed of progress throughout.

Professional obligations

Our practitioners are bound by the professional rules and ethics of their respective qualifications. These obligations take precedence where they conflict with instructions. We will explain the position if this arises.

8. Disclaimers

The information on this website is provided for general informational purposes only and does not constitute legal advice. It does not create a solicitor-client relationship.

While we take care in providing our Services, the outcomes of legal matters can be affected by many factors beyond our control, including court decisions, regulatory changes, and the actions of other parties. We do not warrant or represent any particular result from engaging our Services.

Website content is provided in good faith and kept updated where practicable, but we do not warrant its completeness or currency at any given time.

9. Limitation of Liability

To the extent permitted by Thai law, our total liability to you in connection with any matter shall not exceed the fees paid to us for the specific service giving rise to the claim.

We shall not be liable for indirect, consequential, or special loss, including loss of expected inheritance, loss of opportunity, or loss arising from delays outside our control.

Nothing in this Agreement limits liability for fraud, gross negligence, or matters that cannot lawfully be excluded under Thai law.

10. Indemnification

You agree to indemnify and hold harmless Damrong, its practitioners, and staff from any claims, losses, or costs (including reasonable legal costs) arising from:

  • Your provision of inaccurate or incomplete information that affects our ability to act properly in your matter;
  • Your breach of any term of this Agreement;
  • Any unlawful use of this website by you.

11. Termination

Either party may terminate an engagement on written notice. We will provide you with a clear account of work completed and any documents produced to that point.

We may withdraw from a matter where continuation would be inconsistent with our professional obligations, where instructions conflict with applicable law, or where a breakdown of trust has occurred. In such cases we will give you reasonable notice and assist in the handover of your matter where possible.

Termination does not affect any rights or obligations that have already arisen. Sections relating to payment, confidentiality, intellectual property, liability, and dispute resolution survive termination.

12. Dispute Resolution

This Agreement is governed by the laws of the Kingdom of Thailand. The courts of Bangkok shall have jurisdiction over any dispute arising under this Agreement.

Before commencing any formal proceedings, we encourage both parties to attempt to resolve any disagreement through direct discussion. Many concerns can be addressed quickly and straightforwardly when raised with us directly.

Where informal resolution is not achieved, the parties may consider mediation through a mutually agreed mediator before pursuing litigation.

13. General Provisions

  • Entire agreement. This Agreement, together with any engagement letter, constitutes the entire agreement between us regarding the subject matter hereof.
  • Severability. If any provision of this Agreement is found to be unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.
  • Waiver. Failure to enforce any right under this Agreement shall not constitute a waiver of that right.
  • Assignment. You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign our obligations to a suitably qualified practitioner within our firm.

14. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our practice, applicable law, or other relevant factors. We will publish any revised version on this page with an updated effective date.

Continued use of this website or our services following any update constitutes acceptance of the revised terms. We encourage you to review this page periodically.
